To put it simply, we collect information that you provide to us. When you register for our Services, express interest or participate in activities on our services, we collect the information you provide us

When you engage with our Marketing Activities or communicate with our sales or support teams, we collect information from form submissions, surveys, emails, or phone calls. This may include the nature of your communication, your contact preferences, and any additional details you provide in open text fields.
    • Image and Audio Information. We may collect your image or audio recordings during phone or video when you contact us as such, or during events hosted by us.
    • Troubleshooting and Support Information. We collect information about your account preferences or information you provide when you contact us for support, such as but not limited to the solution you use, the content of chats and other communications with us that help us provide support or comply with legal obligations.
    • Social Media Information. Our Sites and Services may use social media features that may collect your information. Figurative is not responsible for how these social media features collect, process, and disclose your information, so we encourage you to review the social media platforms' privacy policies.
    • Any Information You Voluntarily Provide to Us. For example, when you provide feedback on your experience with our Services or join a public discussion forum as part of our Marketing Activities.
  • Information We Receive From Third-Parties

    We may receive infromation about Customers from third-parties and partners that provide addon services or support to our Customers. We restrict our collection and usage of such data to their intended purposes only

    • Connectable Information. We collect information that enables us to associate incoming information with our customers. Some of this may include customer id, name, or organizational information
    • Transaction & Metadata. We may collect transactional data provided or generated as part of usage of third-party services.
  • Information We Collect Automatically

    We may receive infromation about Customers from third-parties and partners that provide addon services or support to our Customers. We restrict our collection and usage of such data to their intended purposes only

    • Usage Information. We track how you interact with our Sites, Marketing Activities, and Services. This includes details like clicks, pages viewed, searches, browser type, page response times, errors, timestamps, referring and exit pages, time spent on our Sites, and information about other websites you've visited recently.
    • Device Information. We gather data on how your devices interact with our Sites and Services. This includes your browser type and settings, device details like screen size and operating system, language preferences, Internet Service Provider, mobile network details, push notification tokens, and unique device identifiers.
    • Service-Generated Information. We collect data generated from your use of our Services and Sites, including log files, IP address, location data derived from IP, server performance metrics, diagnostic information, and your chosen privacy and security settings.
    • Location Information. We collect general location data like city and country based on your IP address. We do not track precise location.
    • API Information. We gather data from Third-Party Services connected to us, including functional information and events initiated by Customers, such as authentication tokens and database URLs.
    • Cookies. We use cookies and similar tracking technologies to collect information from your browser. Depending on your settings, this may include a cookie ID. We obtain your consent where required by law, and you can choose to delete or refuse our cookies as outlined in our Cookie Policy

Use of Information

We use this information to provision our Services and to better meet our users' needs. The ways include and are not limited to:

Data Disclosure

We only disclose information on need basis or as required by law, or as part of our practices as follows:

    • Affiliates and Subsidiaries. We may share your information with companies that are related to Figurative, and across our Sites and Services. These affiliates and Services will treat your data according to this privacy notice.
    • New Owner or Business Transactions. If our company undergoes a merger, sale, or reorganization, your information may be transferred as part of the transaction. You'll be notified if there are significant changes in ownership.
    • Our Customers. When you interact with our Services, your information might be shared with the Customers you’re working with, such as team administrators. We encourage you to read the Customer's privacy notice before acquiring their services
    • Partners and Event Sponsors. We may share your information with partners, event sponsors, or advertisers to support our services and marketing efforts.
    • Third-Party Service Providers. We work with various third-party providers to support our operations, including hosting, payment processing, customer support, security, and analytics. They only use your information as needed to provide their services.

  • These Third-Party Services have their separate privacy policies and terms of use that are not tied to this Policy. We are not in anyway responsible for the content, accuracy, or opinions expressed in such Third-Party Services.

  • We do not verify the accuracy or completeness of these Third-Party Services. We strongly recommend that you review the terms and privacy policies of each Third-Party Service before using them to ensure they meet your compliance, privacy, and security needs.

Data Transfer

If you are accessing or using our Sites and Services or otherwise providing your information to us, you consent to the processing of your information in the United States and other jurisdictions in which we operate. By using Figurative’s Services, you agree that your personal data will be handled in the U.S. In accordance with Article 46 of the GDPR, Figurative and our Sites implement appropriate safeguards through binding standard data protection clauses, enforceable by individuals in the EEA and the UK. These clauses have been updated based on European Data Protection Board guidance and will be revised when new model clauses are approved.
